Superbio.ai Inc. (the “Company”) is committed to maintaining robust privacy protections for its users. Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Service.  This Privacy Policy applies to information we collect when you access or use our websites, mobile applications, and other online products and services, or when you otherwise interact with us, such as through our customer support channels, or on social media pages.

For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at https://www.superbio.ai. “Service” refers to the Company’s services accessed via the Site, in which users can perform certain functions including the following:

• Upload data to our Site from your computer’s local storage or a range of remote storages including Google Drive and AWS S3.
• Store, process, clean, edit and view data that either you have uploaded or selected from our open data collection.
• Use our “Machine Learning Workstation” to train machine learning models with your data or our open data, and visualize results of said model training.
• Apply no-code artificial intelligence based tools in our “App Store” to apply your data.
• Discover third party AI tools

The terms “we,” “us,” and “our” refer to the Company. “You” refers to you, as a user of our Site or our Service.

Information Superbio.ai inc. May Collect From You

Our primary goals in collecting information are to provide AI based biological services to you, to improve our Site, features, content, and to run our business. We collect “Non-Personal Information”, “Personal Information”, and information you voluntarily provide. Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data. Personal Information includes   information that is deemed “personal data” or “personal information” (or other analogous variations of such terms) under data protection law.

Information That You Voluntarily Provide

We collect information you provide directly to us. For example, we collect information directly from you when you create an account, fill out a form, submit or post content through our Services, make a purchase, communicate with us via third-party platforms, participate in a contest or promotion, request customer support, or otherwise communicate with us. The types of information about you that we collect may include your name, email address, postal address, phone number, payment information, a form of identification, and any other information you choose to provide. Additionally, if you make a purchase, we work with a third-party payment processor to collect and process your payment information.

Superbio.ai inc. collects and stores the biological data (genomic, medical record, medical image, etc.), derived from humans or other organisms, that you submit to the site along with metadata and other information related to such data. In the case of sensitive data (e.g. medical), you agree to and accept full responsibility for obtaining all necessary permissions and informed consent from all parties from which your submitted data is composed of.

HIPAA, Protected Health Information, and the Clinical Compliance Features

Superbio.ai inc. is not a Covered Entity as that term is defined in the Health Insurance Portability and Accountability Act of 1996, as amended, and its related regulations (collectively, "HIPAA"). On occasion, Superbio.ai inc. may agree in writing with a user to perform services for the user in the capacity of a Business Associate under HIPAA. We offer a separate HIPAA Business Associate Privacy Agreement ("BA Privacy Agreement") for HIPAA-regulated users, and we recommend that such users enter into a BA Privacy Agreement with Superbio.ai inc. prior to uploading, storing, or otherwise transferring "protected health information" as defined in HIPAA ("PHI") using the Site.

Users who desire to upload, store, or otherwise transfer PHI using our services must implement all of the required clinical compliance features (“Compliance Features”). The uploading, storing, or transferring of PHI using the services by users that have not implemented the Compliance Features is strictly prohibited. You agree that, unless you have implemented the Compliance Features, you will not upload, store, or otherwise transfer PHI using the services. You acknowledge that this may require you, in some instances, to anonymize PHI prior to uploading it to the services such that the PHI cannot be traced back to an individual. You further agree to indemnify and hold harmless Superbio.ai inc. of and from any and all claims, demands, losses, causes of action, damage, lawsuits, judgments, including attorneys' fees and costs, arising out of or relating to your uploading, storing, or transferring of PHI without having fully implemented the Compliance Features. Please note that for any personal information we receive which is PHI, Superbio.ai Inc. will be a processor for the purposes of processing this personal information.
